Summary Tribunal remedy for parents and senior citizens to claim maintenance from children and relatives, and to void transfers of property made on the condition of being maintained.
A senior citizen unable to maintain himself from his own earnings or property may apply against children (or, for a childless senior citizen, relatives who would inherit); the obligation extends to needs for a normal life.
Application to the Tribunal by the senior citizen, or by an authorised person or organisation, or on the Tribunal's own motion; interim maintenance may be ordered; disposal within ninety days.
The Tribunal may order a monthly allowance (the ₹10,000 cap was removed by rules in several States; check the State rules).
Where a senior citizen has transferred property by gift or otherwise subject to a condition that the transferee provide basic amenities and physical needs, and the transferee refuses, the transfer is deemed fraudulent and may be declared void at the transferor's option.
