Protection of Women from Domestic Violence Act, 2005

Domestic relationship

A relationship between two persons who live or have lived together in a shared household, related by consanguinity, marriage, a relationship in the nature of marriage, adoption or as family members of a joint family.

Definition of domestic violence

Any act or omission that harms or endangers health, safety, life or well-being — physical, sexual, verbal and emotional, or economic abuse — or harassment for dowry.

Application to Magistrate

The aggrieved person or a Protection Officer may apply for reliefs under the Act; the Magistrate shall fix the first hearing within three days and endeavour to dispose of it within sixty days.

Right to reside in a shared household

Every woman in a domestic relationship has the right to reside in the shared household whether or not she has any title in it; she cannot be evicted except by procedure established by law (Satish Chander Ahuja, 2020).

Prohibiting the respondent from committing domestic violence, entering the workplace, communicating, alienating assets, or causing violence to dependants.

Monetary reliefs

Loss of earnings, medical expenses, loss caused by destruction of property, and maintenance for the aggrieved person and her children — adequate, fair and consistent with the standard of living.
