Licence for acquisition and possession of firearms and ammunition

No person shall acquire, have in possession or carry any firearm or ammunition unless holding a licence; a person may hold up to two firearms (post-2019).

Unlicensed possession, manufacture, sale or transfer — imprisonment of three to seven years and fine; higher tiers for prohibited arms and illicit trafficking.

Punishment for using arms

Using a firearm in contravention of s. 5 — three to seven years; using a prohibited arm — seven years to life; using a prohibited arm resulting in death — life imprisonment or death (as read down in Dalbir Singh, 2012).

Previous sanction of the District Magistrate necessary in certain cases

No prosecution shall be instituted against any person in respect of an offence under s. 3 without the previous sanction of the District Magistrate.
